Terms of Service

These Terms of Service ("Terms") govern your use of MacMetal Miner Pro Max (the "Software") provided by Distributed Ledger Technologies ("Company", "we", "us", or "our"), founded by David Otero.

By purchasing, downloading, installing, or using the Software, you agree to be bound by these Terms.

1. License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for personal, non-commercial purposes.

• Monthly subscription licenses are valid while your subscription is active
• One license per user; licenses may not be shared or resold
• The license may be revoked for violation of these Terms

2. Risk Disclosure

By using the Software, you acknowledge and accept:

1. Solo mining is speculative and high-risk
2. There is NO GUARANTEE you will ever find a block or earn any Bitcoin
3. You are solely responsible for electricity costs incurred
4. Past performance of other miners does not guarantee future results
5. The Software provides ACCESS to mining, not guaranteed rewards

3. Subscription & Payments

• Subscriptions are billed monthly through Gumroad
• You may cancel your subscription at any time
• Refunds are subject to Gumroad's refund policy
• Chargebacks or disputes will result in immediate license revocation

4. Prohibited Uses

You agree NOT to:

• Share, distribute, or resell your license key
• Reverse engineer, decompile, or modify the Software
• Use the Software for any illegal purpose
• Circumvent license verification mechanisms
• Use the Software in a manner that violates any applicable laws

5. Intellectual Property

The Software, including its code, design, and documentation, is the intellectual property of Distributed Ledger Technologies and David Otero. This software is provided under a source-available license. See the LICENSE file for complete terms.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF RESULTS

We do not warrant that the Software will be uninterrupted, error-free, or secure.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the Software in the 12 months preceding the claim
• We are not liable for any losses related to cryptocurrency mining, including but not limited to: electricity costs, hardware wear, missed block rewards, or price fluctuations

8. Third-Party Services

The Software connects to third-party services (mining pools, price APIs, license verification). We are not responsible for:

• Downtime or errors of third-party services
• Changes to third-party terms or policies
• Data handling by third parties

9. Termination

We may terminate or suspend your license immediately, without prior notice, for any breach of these Terms. Upon termination:

• Your right to use the Software ceases immediately
• You must uninstall and delete all copies of the Software
• No refund will be provided for termination due to Terms violation

10. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Software after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and Distributed Ledger Technologies regarding the Software and supersede all prior agreements.
